These Terms and Conditions govern the hire of equipment from Dunsborough Hire, located at 3/12 Clark St, Dunsborough, WA 6281. By renting equipment from us, you (“the Hirer”) agree to comply with these terms. Please read them carefully.

1. Hire of Equipment

1.1 The Hirer is entitled to use the equipment for the agreed hire period, as specified in the hire agreement or booking confirmation.

1.2 Any extension of the hire period must be approved in writing by Dunsborough Hire (“the Owner”).

1.3 Equipment includes, but is not limited to, bobcats, excavators, dingos, trailers, compactors, cement mixers, and other tools listed in our catalogue.

2. Payment for Hire

2.1 The Hirer agrees to pay the hire fees as specified in the booking confirmation, including any applicable GST, stamp duties, tolls, fines, penalties, levies, or freight charges related to the hire.

2.2 Payment is due as per the agreed terms (e.g., upon booking or equipment return). Late payments may incur additional fees.

2.3 If equipment is not returned on time and in accordance with these terms, the Hirer will be charged the agreed hire rate until the equipment is returned in full.

2.4 In case of a dispute, the Hirer is responsible for all legal costs and collection fees incurred by Dunsborough Hire.

3. Use, Operation, and Maintenance

3.1 The Hirer acknowledges that operating equipment carries risks of injury or damage and accepts all such risks.

3.2 Only the Hirer, or individuals explicitly authorized by Dunsborough Hire, may use the equipment.

3.3 The Hirer must ensure that all operators are trained in the safe and proper use of the equipment and, where required (e.g., for scissor lifts or cherry pickers), hold a valid Certificate of Competency or equivalent license.

3.4 The Hirer agrees to operate, maintain, store, and transport the equipment in accordance with Dunsborough Hire’s instructions and with due care and diligence.

3.5 The Hirer must not modify, tamper with, or misuse the equipment in any way.

3.6 For equipment requiring fuel (e.g., Bobcat S70, Stihl TS800 quick cut), the Hirer must use the correct fuel type as specified by Dunsborough Hire.

4. Condition and Return of Equipment

4.1 The Hirer must return the equipment to Dunsborough Hire clean of all foreign matter (e.g., dirt, debris). If the equipment is returned unclean, a reasonable cleaning fee will be charged.

4.2 Equipment requiring fuel must be returned with a full tank. If not refueled, the Hirer agrees to pay a refueling fee of $2.20 per liter.

4.3 The Hirer is responsible for any damage to the equipment beyond normal wear and tear. Repair or replacement costs will be charged to the Hirer.

4.4 Equipment must be returned to 3/12 Clark St, Dunsborough, WA 6281, by the agreed date and time, unless Dunsborough Hire arranges pick-up.

5. Hirer’s Warranties

5.1 The Hirer warrants that:

• The equipment will be used in accordance with these terms and any specific conditions outlined in the hire agreement.

• The equipment will not be used for illegal purposes or in a manner that violates any laws or regulations.

• The Hirer will provide accurate identification and contact details, including a driver’s license if required (e.g., for trailer or heavy machinery hires).

6. Liability and Indemnity

6.1 The Hirer is liable for any loss, damage, or injury caused by the use or misuse of the equipment, except where caused by Dunsborough Hire’s negligence.

6.2 The Hirer agrees to indemnify Dunsborough Hire against any claims, damages, or losses arising from the Hirer’s use of the equipment.

6.3 Dunsborough Hire is not liable for any indirect or consequential losses (e.g., project delays) arising from the use or failure of the equipment.

7. Insurance

7.1 The Hirer is responsible for insuring the equipment against loss, theft, or damage during the hire period, unless Dunsborough Hire provides insurance as part of the hire agreement.

7.2 The Hirer must notify Dunsborough Hire immediately of any incident that may lead to an insurance claim.

8. Termination of Hire

8.1 Dunsborough Hire may terminate the hire agreement immediately if the Hirer breaches these terms, fails to pay fees, or uses the equipment unsafely or illegally.

8.2 Upon termination, the Hirer must return the equipment immediately, and all outstanding fees will become due.

9. Completion of Hire Period

9.1 The hire period ends when the equipment is returned to Dunsborough Hire in the same condition as when hired (normal wear and tear excepted):

• On or before the agreed date and time specified in the hire agreement; or

• On the date agreed for pick-up by Dunsborough Hire.

9.2 If the Hirer fails to return the equipment on time, additional hire fees will apply until the equipment is returned.

10. Disputes

10.1 Any disputes arising from this agreement will be resolved through mediation before proceeding to litigation, in accordance with Australian law.

10.2 These terms are governed by the laws of Western Australia.
